In other words, only cases disposed of on or after July 1, 2025, will be subject to the new revocation requirement.<\/p>\n<\/div><\/div>\r\n\r\n<div class=\"wm-item wm-item-wrap\"><h3 class=\"wm-item-title\" data-tags=\"\" data-tag-names=\"\">How does this affect me?<\/h3><div class=\"wm-item-content clearfix Howdoesthisaffectme\"><p>As a qualified patient or caregiver in Florida&#8217;s medical marijuana program, according to sections <a href=\"http:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0300-0399\/0381\/Sections\/0381.986.html#:~:text=(d)%E2%80%83The,6)(b)6.\">381.986(5)(d)-(e), Florida Statutes (F.S.)<\/a>, if you are charged with <strong>any<\/strong> violation of chapter 893, the OMMU must suspend your registration as a patient or caregiver until final disposition of the alleged offense.As a result of the new law, the OMMU must <em>revoke<\/em> your MMUR registration if you are convicted of, or plead guilty or nolo contendere to, regardless of adjudication, a violation of chapter 893, if such violation is for trafficking in, the sale, manufacture, or delivery of, or possession with intent to sell, manufacture, or deliver a controlled substance on or after July 1, 2025.<\/p>\n<\/div><\/div>\r\n\r\n<div class=\"wm-item wm-item-wrap\"><h3 class=\"wm-item-title\" data-tags=\"\" data-tag-names=\"\">Will I be notified if my card is suspended or revoked?<\/h3><div class=\"wm-item-content clearfix WillIbenotifiedifmycardissuspendedorrevoked\"><p>Yes, the OMMU will notify a patient or caregiver via certified mail that their Medical Marijuana Use Registry (MMUR) registration has been suspended or revoked. Additionally, the patient or caregiver will receive an email from the MMUR notifying them of the suspension or revocation of their registration.<\/p>\n<\/div><\/div>\r\n\r\n<div class=\"wm-item wm-item-wrap\"><h3 class=\"wm-item-title\" data-tags=\"\" data-tag-names=\"\">If my MMUR registration was revoked, can it be reinstated?<\/h3><div class=\"wm-item-content clearfix IfmyMMURregistrationwasrevokedcanitbereinstated\"><p>Yes, if a qualified patient or caregiver whose registration was revoked wishes to seek reinstatement of his or her MMUR registration as a qualified patient or caregiver, the person may submit a <a href=\"https:\/\/knowthefactsmmj.com\/attestation-form\/\" target=\"_blank\" rel=\"noopener\"><strong><em>notarized<\/em><\/strong> attestation<\/a> that he or she has completed all terms of incarceration, probation, community control, or supervision related to the offense(s), and documentation supporting that claim.Please note that <strong>all<\/strong> terms of incarceration, probation, community control, or supervision must be complete. The OMMU will review the supplied materials to determine if the patient or caregiver&#8217;s registration qualifies for reinstatement. It is important to note that any person who knowingly makes a false attestation under this paragraph commits a misdemeanor of the second degree, punishable as provided in section 775.082 or 775.083, F.S.<\/p>\n<\/div><\/div>\r\n\r\n<div class=\"wm-item wm-item-wrap\"><h3 class=\"wm-item-title\" data-tags=\"\" data-tag-names=\"\">What documentation is needed for reinstatement of a patient or caregiver MMUR registration after a revocation?<\/h3><div class=\"wm-item-content clearfix WhatdocumentationisneededforreinstatementofapatientorcaregiverMMURregistrationafterarevocation\"><p>To apply for reinstatement of a patient or caregiver MMUR registration following a revocation, you must submit a <a href=\"\/attestation-form\/\" target=\"_blank\" rel=\"noopener\">notarized attestation<\/a> swearing under penalty of perjury that you have completed all terms of incarceration, probation, community control, or supervision related to the offense(s).\u00a0<strong>Please note: <\/strong>Once approved for reinstatement by the OMMU, the person applying for reinstatement must be recertified by a qualified physician to determine if he or she still qualifies for the medical use of marijuana within Florida&#8217;s Medical Marijuana Use Program.
